The agreements and policies that apply when you use Avortyx.
Acceptable Use Policy
What you may and may not do with Avortyx numbers, routing, messaging and data.
1. Purpose
This Acceptable Use Policy ("AUP") applies to everyone who uses the Avortyx platform, including customers, their users, publishers and buyers who connect to it. It forms part of the Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.
Avortyx carries live calls and messages over upstream carrier networks. Misuse by one account can harm callers, carriers and every other customer, so we enforce this policy actively.
2. Prohibited uses
You may not use the platform, or allow anyone to use it, to:
- Place calls or send messages without the consent required by the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing laws or carrier rules.
- Call or text numbers on the National Do Not Call Registry, a state list, your internal suppression list or an Avortyx suppression list, unless a valid exemption applies.
- Spoof caller ID, transmit misleading or inaccurate caller ID information, or rotate numbers to evade spam labeling or call blocking.
- Run robocall, pre-recorded or artificial voice campaigns that the law does not permit.
- Route traffic that is fraudulent, deceptive, generated by bots or velocity schemes, or designed to inflate billable calls or payouts.
- Promote illegal products or services, or content that is defamatory, harassing, hateful, sexually explicit involving minors, or that infringes intellectual property.
- Record calls without the notice or consent required in the caller's and recipient's jurisdictions.
- Resell, white-label or sublicense the platform without written authorization from Avortyx.
- Probe, scan or test the platform's security, interfere with its operation, or attempt to access accounts or data that are not yours.
3. Traffic quality
Abandoned, unanswered and rejected calls place load on carrier networks. When over a fifth (20%) of the calls an account tried to place in the past 30 days went unanswered (abandoned at 0 seconds), or calls are repeatedly rejected for lack of an eligible destination, Avortyx may apply the network surcharges described on the pricing page and in the Terms of Service, limit call volume, or ask you to correct the traffic source.
4. Monitoring and enforcement
Avortyx may review campaigns, call metadata, recordings and messages to confirm compliance with this AUP, applicable law and carrier requirements. If we believe a violation has occurred we may, with or without notice: suspend numbers, campaigns or the account; block specific traffic; pass through carrier fines, traceback fees or penalties caused by your traffic; and cooperate with carriers, the Industry Traceback Group, regulators and law enforcement.
5. Reporting abuse
Report suspected abuse of an Avortyx number to support@avortyx.com with the number, date and time, and a short description. We review every report.

TCPA & Consent Compliance Policy
Your responsibilities for consent, Do Not Call, suppression and record-keeping, and the tools Avortyx provides.
1. Your responsibility
You are solely responsible for making sure that every call and message you place, route or receive through Avortyx complies with the TCPA, the Telemarketing Sales Rule, state telemarketing and mini-TCPA laws, and carrier policies. Avortyx's compliance tools help you meet those obligations; they do not transfer them to Avortyx and are not legal advice.
2. Consent
Where consent is required, you must obtain prior express written consent that clearly names you and Avortyx as parties who may contact the consumer, discloses the use of automated technology and pre-recorded messages where applicable, and states that agreeing is not required to buy anything. What the consent wording must cover is set out in section 5.2 of the Terms of Service.
3. Consent records
Keep consent records for at least five (5) years, or longer where law requires. Each record must include:
- Opt-in date and time
- Source (the web page, form or call where consent was given)
- First and last name
- Address
- Phone number
- Any other information collected at opt-in
You must produce consent records to Avortyx on request within the time stated in the Terms of Service.
4. Do Not Call and suppression
Scrub your lists against the National Do Not Call Registry, applicable state lists and your internal Do Not Call list before every campaign. Where Avortyx provides a suppression list, clean your lists against it no less than once in any three (3) business days, and never call or text a number on it.
5. Tools Avortyx provides
Depending on your plan and configuration, Avortyx can screen each attempt before it reaches a buyer against federal, state and internal DNC lists, check for consent proof, flag VoIP and velocity fraud signals, and apply per-state two-party recording rules. The screening decision is stored on the call record and can be exported for audit. These tools reduce risk; they do not guarantee compliance.
6. Litigation and complaints
If you receive a complaint, demand letter or lawsuit about traffic that used Avortyx, notify us promptly as required by the Terms of Service, and preserve all related records.

Service Level Agreement
Routing uptime commitments for Growth and Enterprise plans, and how to claim a service credit.
1. Scope
This Service Level Agreement ("SLA") applies to customers on a Growth or Enterprise plan with a current, paid-up account. It covers the availability of the Avortyx call routing service. It does not cover reporting dashboards, integrations, or carrier networks outside Avortyx's control.
2. Commitment
- Growth plans: 99.9% monthly routing uptime.
- Enterprise plans: 99.99% monthly routing uptime, with guaranteed response times, a dedicated support channel and private routing infrastructure as set out in the Order Form.
Monthly routing uptime is the percentage of minutes in a calendar month in which the routing service accepted and routed calls, excluding the exclusions below.
3. Exclusions
Downtime does not include time caused by: scheduled maintenance announced in advance; upstream carrier, internet or third-party outages; force majeure events; your equipment, destinations, buyers or integrations; suspension under the Terms of Service or the Acceptable Use Policy; or traffic that exceeds agreed limits.
4. Service credits
If Avortyx misses the commitment in a month, you may request a service credit against future fees. Credit amounts are set out in your Order Form. Credits are your sole and exclusive remedy for missing this SLA, are not refundable as cash, and cannot exceed the fees for the affected month.
5. How to claim
Email support@avortyx.com within 30 days after the end of the affected month with your account name, the dates and times of the outage, and affected numbers or campaigns.

Billing, Cancellation & Refund Policy
How usage is billed, how to cancel, and when refunds apply.
1. Usage-based billing
Avortyx bills on usage at the rates on the pricing page or in your Order Form, with volume discounts and no onboarding fees. Billing increments are:
- Inbound calls: billed per minute, rounded up to the nearest full minute. Forwarding a call to a buyer over toll-free or SIP is included in the inbound rate; international and premium rate centers can add cost.
- Outbound calls: billed on call duration at the increment and minimum billable duration configured for your account, as stated in your rate sheet.
- Tracking numbers and number protection: a monthly rate per number.
- Messaging, transcription, schedule steps and recording storage: at the rates on the pricing page.
2. Surcharges and pass-through fees
When over a fifth (20%) of the calls you tried to place in the past 30 days went unanswered (abandoned at 0 seconds), each call carries the surcharge shown on the pricing page. Calls rejected because they have nowhere eligible to go are charged per call. Carrier administrative fees, traceback fees and penalties caused by your traffic are passed through to your account.
3. Balance and payment
Keep a positive balance. If usage exceeds your deposit or fees go unpaid, Avortyx may suspend the account. If your balance remains negative for ninety (90) days in a row, recording retention drops to ninety (90) days and anything older is deleted for good.
4. Cancellation
Cancel whenever you like, in the dashboard or through our support team. We process a cancellation within three (3) calendar days. Recurring charges then stop, and access continues until the end of the current billing cycle.
When access ends, campaign content, call logs and recordings become inaccessible, and rented local and toll-free numbers are released to the carriers and cannot be recovered. Port numbers out or export data before your cycle ends.
5. Refunds
Usage fees are not refundable. Avortyx may refund deposited amounts that have not been used for the service, less any outstanding fees, surcharges or pass-through charges.

Call Recording & Data Retention Policy
How long Avortyx keeps recordings, logs and personal information, and how deletion works.
1. Call recordings
Recordings are kept free of charge for ninety (90) days. Recordings you choose to keep beyond 90 days are billed monthly per minute stored, at the rate on the pricing page. You can delete recordings at any time.
2. Recording consent
Some states require every party to a call to consent to recording. You are responsible for giving the notice and obtaining the consent that applies to each call. Avortyx can apply per-state two-party recording rules to help you do this.
3. Automated redaction
By default, ninety (90) days after data goes inactive the platform masks or removes the personal details in it and in system logs, such as names, dates of birth and street addresses. You may be able to change this period for your account; if you do, you are responsible for the retention you choose.
4. Consent records
Consent records you keep for TCPA purposes must be kept for at least five (5) years. Because redaction can remove personal information from inactive data, keep your consent records in your own systems as well, as the Terms of Service require.
5. After cancellation or non-payment
When an account is closed, call logs and recordings become inaccessible. If an account’s balance is negative for ninety (90) days in a row, every recording more than ninety (90) days old is deleted for good.
6. Legal holds
Avortyx may keep data longer where needed to meet a legal obligation, respond to lawful requests, resolve disputes or enforce our agreements.

Messaging (SMS) Terms
Additional terms for sending and receiving text messages through Avortyx numbers.
1. Registration
Application-to-person (A2P) messaging on local numbers requires 10DLC brand and campaign registration, and toll-free messaging requires toll-free verification. Messages from unregistered or unverified numbers may be blocked or filtered by carriers.
2. Consent and opt-out
Send messages only to people who have given the consent required for that type of message. Honor STOP and other opt-out keywords immediately, and respond to HELP with your business name and contact details.
3. Privacy policy requirement
Messaging requires a privacy policy that anyone can read on your website. Under A2P 10DLC rules it has to say that you never sell or hand over mobile numbers, SMS consent or messaging data to any third party for its marketing purposes.
4. Content
Messages must not contain prohibited content under the Acceptable Use Policy or carrier rules, including content about cannabis, firearms, high-risk financial offers or other categories carriers restrict.
5. Billing
Outbound messages are billed per message. Inbound messages on local numbers are free; inbound messages on toll-free numbers can bill at your toll-free inbound SMS rate. Carrier fees for registration and filtering are passed through.

AI Features Terms
Terms for call scoring, transcription and other AI-powered features.
1. What these cover
These terms apply when you use AI-powered features in Avortyx, such as intent scoring, transcription and call summaries. They add to the Terms of Service.
2. Outputs
AI outputs are generated automatically and can be inaccurate or incomplete. Review outputs before relying on them for routing, payout, compliance or employment decisions. You are responsible for how you use outputs.
3. Third-party providers
Some AI features are provided by third-party model or voice providers. Where you connect your own provider, your use of that provider is governed by your agreement with them. Call audio and transcripts sent to a provider are processed as described in the Privacy Policy.
4. Disclosures
If you use an artificial or AI-generated voice to speak with consumers, you are responsible for any disclosure that law requires, and for meeting consent rules that apply to artificial or pre-recorded voices.
5. Restrictions
Do not use AI features to impersonate a real person without authorization, to generate content that breaks the Acceptable Use Policy, or to make decisions that law reserves for a human.

Emergency Calling (911) Notice
Avortyx numbers are for tracking and routing business calls, not for emergency calls.
1. No emergency calling
Avortyx is a platform for tracking and routing calls. Avortyx numbers do not support 911 or E911 calling, and the service is not a replacement for a landline or mobile phone service.
2. Your users
Make sure everyone who uses Avortyx numbers on your behalf, including agents and call centers, has another way to reach emergency services.
3. No liability
Avortyx bears no responsibility if emergency services cannot be reached through the platform.

Cookie Policy
The cookies and browser storage the Avortyx website uses, and how to control them.
1. What we use
- Essential: the OKCookie cookie, which remembers that you accepted the cookie notice.
- Functional: the help chat conversation while you browse (avx-help-2, kept only for the browser session); once you write to our team, a reference to that chat (avx-help-live-2, used for up to 7 days) so their answer is waiting when you come back; and a preview setting our team uses to review page designs (avx-preview).
- Analytics: Google Analytics, to count visits and see which pages, links and features are used.
2. Your choices
You can block or delete cookies and site data in your browser settings. Blocking essential storage may stop parts of the site from working. You can opt out of Google Analytics with Google's browser add-on.
3. The platform
The Avortyx application uses cookies to keep you signed in and secure your session. Those cookies are necessary for the service and cannot be turned off.

How to use the Avortyx name and logo.
1. Our marks
The Avortyx name and logo are trademarks of Avortyx. Approved logo files and colors are in the Brand Kit.
2. You may
- Use the name "Avortyx" to refer accurately to our company and platform.
- Use unmodified logo files from the Brand Kit to show that you integrate with or use Avortyx.
3. You may not
- Change, animate, recolor or combine the logo with other marks.
- Use the marks in a way that suggests Avortyx sponsors or endorses you, without written permission.
- Use "Avortyx" or a similar name in your company, product, domain or social media name.
4. Questions
For permission or questions, email support@avortyx.com.

Partner & Affiliate Program Terms
Terms for agencies and affiliates who refer customers to Avortyx, including how to promote us in search, on websites and on social media.
1. The program
The Avortyx Partner & Affiliate Program lets approved partners refer new customers to Avortyx and earn commission on what those customers pay. Joining is by application, and Avortyx may accept or decline any application without giving a reason.
These terms apply alongside your partner agreement, the Terms of Service, the Acceptable Use Policy and the Trademark & Brand Guidelines. If your partner agreement says something different from these terms, the partner agreement applies.
2. Eligibility
- You must be a business or an individual of legal age, able to enter into contracts and to receive payments in your own name.
- Your websites, channels and audience must fit the rules in sections 6 to 8.
- Current Avortyx employees and their households may not join.
- Existing customers may join, but cannot earn commission on their own account.
3. What counts as a referral
A referral counts when a new customer signs up through your partner link or code, or when you register them with Avortyx before they sign up. The customer must not already have an Avortyx account, and must not already be in an active sales conversation with our team.
If two partners claim the same customer, the referral goes to the partner whose link or registration came first in our records. Our records decide the attribution.
4. Referrals that earn no commission
No commission is paid on a referral that:
- signs up with you, your company or anyone you control as the customer (self-referral);
- cancels, is refunded, or is suspended for non-payment or a policy breach before the end of the qualifying period in your partner agreement;
- came from traffic that breaks these terms, such as bidding on our brand terms or sending unsolicited messages;
- is fraudulent, uses false details, or was created only to earn a commission;
- is not a business that can use Avortyx, such as a consumer looking for personal phone service.
5. Commissions and payment
Commission rates, the qualifying period, payment schedule and minimum payout are set out in your partner agreement or partner portal. Commission is earned only on fees the referred customer actually pays to Avortyx, not including taxes, carrier pass-through charges or credits.
Commission already paid is reversed, or deducted from your next payment, if the fees it was based on are refunded, charged back or found to be fraudulent. You are responsible for any taxes on what you earn, and must give us the tax forms we ask for before we can pay you.
6. Search advertising
Avortyx runs its own paid search campaigns, so partners may not compete with them on our brand.
- Do not bid on "Avortyx", "avortyx.com", misspellings, or terms that combine our name with other words (for example "Avortyx pricing" or "Avortyx login"), and add them as negative keywords in broad-match campaigns.
- Do not use "Avortyx" or any Avortyx domain in an ad’s headline, description or display URL, or in the path after your own domain.
- Ads must send visitors to your own website, never straight to avortyx.com or through a redirect that lands there.
- Your ads must make clear you are an independent partner, not Avortyx itself.
You may run search campaigns on general terms, such as "call tracking software", that point to your own site. Ask us in writing before you run anything that mentions Avortyx by name.
7. Websites and content
- Do not register or use domain names, subdomains, social handles or app names that contain "Avortyx" or something confusingly similar.
- Describe Avortyx accurately. Only make claims about features, prices or results that appear on avortyx.com or that we have approved in writing, and keep them current.
- Do not present a page as an official Avortyx site, or copy our website’s design or text so that it looks like one.
- Clearly disclose that you may earn a commission, close to any link or recommendation, as the FTC Endorsement Guides require.
We will not work with sites or channels that carry hateful, violent, sexually explicit or illegal content, that promote scams, or that infringe someone else’s rights. If we ask you to remove content that breaks this section, you must do so within 48 hours.
8. Email, calls, messages and social media
- Only email, call or text people who have agreed to hear from you, and follow CAN-SPAM, the TCPA, Do Not Call rules and the Acceptable Use Policy.
- Do not spam forums, comment sections, review sites or social media groups with partner links.
- Do not post fake reviews of Avortyx or of competitors, or pay for reviews that are not disclosed.
- You may share your partner link on your own social media accounts, as long as you disclose the relationship.
9. Using our name and logo
We grant you a limited, revocable right to use the Avortyx name and the logos in our partner kit, only to promote Avortyx under these terms. Use them exactly as supplied: do not change their colours, shape or proportions, or combine them with other marks. The right ends when your participation ends.
Do not issue press releases or public announcements about your relationship with Avortyx without our written approval.
10. Monitoring and enforcement
We review partner traffic, ads and content. If we find a breach, we may withhold commission on the traffic involved, suspend your partner link, or end your participation. Serious or repeated breaches, fraud or anything that exposes Avortyx to legal risk can lead to immediate termination and the loss of unpaid commission.
11. Relationship and termination
Partners are independent contractors. Nothing in these terms makes you an employee, agent, franchisee or joint venturer of Avortyx, and you may not make commitments on our behalf.
Either party may end participation at any time with written notice. Commission earned on qualifying referrals before termination is paid on the normal schedule, unless termination was for a breach of these terms.
12. Changes to these terms
We may revise these terms. We will post the new version here with a new date and, for material changes, tell active partners by email. Continuing to promote Avortyx after a change takes effect means you accept it.
13. Contact
To apply, ask about the program or request partner logos, email hello@avortyx.io.
